1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of DesignKit website, mobile application, and related services operated by DesignKit Media Pvt. Ltd. ("Company," "we," "us").

By creating an account, downloading the app, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract under Indian law. If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

You agree to provide accurate, current, and complete registration information and to update it as needed.

4. License & Acceptable Use

We grant you a limited, non-exclusive, non-transferable license to use the Services for lawful business and personal branding purposes.

You agree not to:

• Copy, resell, or redistribute our templates, assets, or software without permission.
• Use the Services to create illegal, defamatory, hateful, or infringing content.
• Reverse engineer, scrap, or attempt to extract source code or template libraries.
• Upload malware or interfere with platform security or performance.

5. Your Content & Our Templates

You retain ownership of content you upload (logos, photos, text). You grant us a license to host, process, and display that content solely to provide the Services.

Templates, fonts, stock elements, and platform designs remain our property or that of our licensors. Your subscription grants you a license to use exported designs for permitted commercial and personal use as described in your plan.

You are solely responsible for ensuring your final designs comply with applicable laws, advertising standards, and third-party rights (including trademarks and celebrity likenesses).

6. Intellectual Property

The DesignKit name, logo, app interface, and underlying technology are protected by copyright, trademark, and other intellectual property laws. Unauthorized use is prohibited.

7. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted access, error-free operation, or specific business results from use of our designs or tools.

8. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.

Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless the Company and its officers, employees, and partners from claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

10. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, fraud, or legal requirements. You may cancel your account at any time through the app or by contacting support.

Upon termination, your right to use the Services ceases. Provisions that by nature should survive (payment obligations, disclaimers, liability limits) will remain in effect.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction, subject to mandatory consumer protection laws in your jurisdiction.

We encourage you to contact us first to resolve disputes informally before pursuing legal remedies.

12. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance. We will provide notice of material changes via the app, email, or website.
